Matrimonial dispute शुरू हुआ…
फिर wife की family ने Facebook पर indirect posts डालने शुरू कर दिए.
“ऐसे husbands को छोड़ देना चाहिए…”
“P for Pajama…”
“200 gms of brain…”
और कुछ posts में husband के husband और father होने पर भी sarcastic comments किए गए.
अब husband के मन में naturally एक सवाल आया:
“क्या मैं अपनी reputation खराब करने के लिए Defamation Case कर सकता हूँ?”
Delhi High Court ने 30 July 2026 को ऐसे ही एक matrimonial-social-media dispute पर फैसला दिया.
Case था Anil Babbar v. Upasana Kapoor & Ors.
The husband, who was himself an advocate, claimed that Facebook posts published by his estranged wife and her family members had damaged his personal and professional reputation.
He sought damages of ₹1 lakh.
लेकिन Court ने एक important legal distinction किया.
सिर्फ यह महसूस होना कि कोई Facebook post आपको insult कर रही है, emotionally hurt कर रही है या आपकी feelings को चोट पहुँचा रही है — अपने-आप में defamation साबित नहीं करता.
Court ने देखा कि कई posts में husband का नाम तक नहीं था और यह भी पर्याप्त evidence नहीं था कि colleagues, clients या professional circle ने उन posts के कारण उसके बारे में अपनी राय खराब कर ली.
Husband के लिए practical point
अगर matrimonial dispute के दौरान आपकी wife, उसके relatives या कोई third person आपके बारे में social media पर posts डाल रहा है, तो हर offensive post को तुरंत “defamation” मान लेना सही strategy नहीं है.

और उससे आपकी reputation पर क्या demonstrable impact हुआ
और एक और important point — Court ने कहा कि केवल disputed matrimonial complaint file कर देना भी अपने-आप defamation नहीं बन जाता.
यानी anger में Facebook पर जवाब देना, relatives को screenshots forward करना या counter-post डालना हमेशा solution नहीं है.
कभी-कभी husband सोचता है, “उसने मेरी insult की है, अब मैं भी सबको दिखाऊँगा.”
यहीं situation और बिगड़ सकती है.
