A 31 August 2026 Central Information Commission decision in Santosh K. Talwar v. Delhi Police, Second Appeal No. CIC/DEPOL/A/2025/137784, dealt with an RTI application arising from a matrimonial criminal case.
The appellant had sought information concerning a complaint made by his daughter-in-law and the subsequent police action.
He specifically sought:
the complaint, FIR, action taken on his emails, supporting evidence/statements, police SOPs and information regarding due diligence before registration of the FIR.
The matter concerned PS North Rohini, Delhi, and the police record referred to a CAW Cell/Rohini enquiry followed by registration of an FIR under Sections 498A/406/34 IPC.
The important part is what happened to the RTI request.
The police provided the appellant with copies of the complaint, FIR and action-taken material, while information concerning evidence and witness statements collected during the investigation was denied by invoking Section 8(1)(h) of the RTI Act, on the ground that disclosure could impede the investigation.
The CIC did not simply say:
“RTI डाल दी है, अब पूरा police file मिल जाएगा.”
No.
The decision shows why an RTI request in a CAW CELL DELHI matter has to be drafted carefully.
There can be a difference between:
Complaint / FIR / available action-taken records
and
investigation material, witness statements and other records whose disclosure may attract a statutory exemption.
The CIC ultimately directed the CPIO to revisit the records concerning the action taken on the appellant's emails and provide a revised reply, including any additional available information, free of cost; if no additional information existed, that also had to be stated.
This is a very practical point for a husband or family member facing a CAW Cell Delhi complaint.
RTI is not just about asking “give me everything.”
The better approach is to identify:
Which record?
Which date?
Which officer/authority?
What action was taken?
What document is actually available?
If information is denied, under which RTI exemption?
और अगर reply में सिर्फ लिखा है “information cannot be provided”, बिना relevant statutory provision properly explaining the denial, that itself deserves examination.
The CIC has dealt with similar CAW Cell RTI disputes, including requests for hearing/order records and police-held documents.
